ಭಾರತದಲ್ಲಿ ತುರ್ತು ಪರಿಸ್ಥಿತಿಯನ್ನು ಹೇರಿ ಪ್ರಜೆಗಳ ಹಕ್ಕುಗಳನ್ನು ದಮನಿಸಿದ, ಜನರನ್ನು ಬಂಧನ, ಚಿತ್ರ ಹಿಂಸೆಗೆ ಗುರಿಪಡಿಸಿದ ಬಗ್ಗೆ ಹಲವಾರು ಪುಸ್ತಕಗಳು, ಲೇಖನಗಳು ಆ ಸಮಯದಲ್ಲಿ ಅಂದರೆ 50 ವರ್ಷಗಳ ಹಿಂದೆ ಬಂದಿದ್ದವು. ಅವುಗಳಲ್ಲಿ ʼಭುಗಿಲುʼ ಮತ್ತು ʼತುರ್ತು ಪರಿಸ್ಥಿತಿಯ ದೌರ್ಜನ್ಯಗಳುʼ ಈ ಎರಡು ಪುಸ್ತಕಗಳ ಕೆಲವು ಅಧ್ಯಾಯಗಳನ್ನು ಆಧರಿಸಿದ ಎರಡು ಸಂವಾದಗಳು ವಿಡಿಯೋ ರೂಪದಲ್ಲಿ ಬರಲಿವೆ.

Dissent is Democracy's Safety Valve: Supreme Court

New Delhi: The Supreme Court on Wednesday, 29^th August 2018, said it would examine contentions that arrest of five civil rights activists in connection with Bhima Koregaon violence was an attempt at muzzling the voice of dissent.

A bench headed by Chief Justice of India Dipak Misra, as a major interim relief, said these activists won't be sent behind the bars for now and will have to be kept under house arrest in their homes till the next hearing on September 6.

"Dissent is the safety valve of democracy and if you don't allow dissent, the pressure valve of democracy will burst," the apex court said as it issued notices to the Centre and Maharashtra government on the petition that has challenged the validity of ten arrests.

Five other activists were arrested in similar raids in the Bhima Koregaon probe in June.

The plea also sought an independent investigation into the entire episode of nationwide raids and subsequent arrests.

Simultaneous raids carried out on Tuesday had targeted the residences of prominent Telugu poet Varavara Rao in Hyderabad, activists Vernon Gonzalves and Arun Ferreira in Mumbai, trade union activist Sudha Bharadwaj in Faridabad and civil liberties activist Gautam Navalakha in New Delhi.

Rao, Bharadwaj, Farreira, Gonzalves and Navalakha were arrested under IPC Section 153 (A), which relates to promoting enmity between different groups on grounds of religion, race, place or birth, residence, language and committing acts prejudicial to maintenance of harmony.

Two of them - Navalakha and Bharadwaj - have been put under house arrest after respective high courts were moved by way of habeas corpus petitions.

Senior advocate Abhishek Manu Singhvi, appearing for a bunch of five petitioners that included noted historian Romila Thapar, submitted before the Supreme Court that there was no need at all to send them to jail until the Court decides the petition.

He suggested they could be put under the house arrest and the bench, also comprising Justices AM Khanwilkar and DY Chandrachud, accepted his plea.

The Centre and state government have been given time till Wednesday to submit their replies to the petition, and the Court will hear the matter again on Thursday next week.

Appearing for Maharashtra, Additional Solicitor General Tushar Mehta, opposed the petition on the ground of maintainability.

"Some of these people have been jailed in the past too," said Mehta.

But Justice Chandrachud shot back: "What are you saying… they are professors. They say it is an attempt to muzzle the voice of dissent. Let us examine it."

Justice Chandrachud added: "Dissent is the safety valve of democracy. If you don't allow dissent, the pressure valve will burst."

When Singhvi said that democracy will be dead if such arbitrary arrests are permitted, the CJI replied: That is why we have issued notices."

News Delhi: Slamming Congress on the 43rd anniversary of imposition of Emergency, Prime Minister Narendra Modi on Tuesday, 26^th June 2018, said India was “turned into a jail for the selfish personal interests” of the Gandhi family.

Addressing a meeting in Mumbai organised by the BJP to mark the Emergency anniversary, Mr. Modi said the day needs to be observed to re-dedicate oneself to protection of the Constitution and democracy.

“Emergency is a black spot on the golden history of the nation. Observing black day today is not just to criticise the Congress for its sin of imposing Emergency but also to create an awareness for protection of Constitution and democracy,” Mr. Modi said.

Lashing out at Congress for “spreading illusionary fear” about the Constitution, Dalits and minorities facing danger (in the BJP-led regime), Modi said Congress can never improve. “For promotion of self interest, they destroyed their own party,” he said.

“For selfish interests, Congress turned the country into a jail by imprisoning opposition leaders. For them, the country and democracy have no value. Instead of (Indira Gandhi) quitting as PM after the court verdict, Emergency was imposed. How can these people talk about safeguarding the Constitution,” he said.

“When Kishore Kumarji refused to sing for them (Congress), his songs were not allowed to be played on the radio,” Mr. Modi said.

Modi accused the Congress of criticising EVMs and the functioning of the Election Commission after they were reduced to 44 seats from 400 in Lok Sabha. “They did not question the EVMs after the recent Karnataka elections,” he added.

He also criticised the Congress for moving an impeachment motion against the Supreme Court chief justice.

“They (Gandhi family) never imagined that they can face corruption charges and be out on bail. Hence, the Congress decided to move impeachment motion against the chief justice,” Mr. Modi said.

Modi said his Government was committed to protecting Constitution and upholding democratic values. “The Constitution is not just a book but a means to fulfil aspirations and wishes of the common man,” he said.

Mr. Modi also paid tributes to Ramnath Goenka of the Indian Express, Kuldeep Nayar and the Statesman newspaper for “standing up” against Emergency.

“Many of them were not our supporters either. Nayar is critical of us. But they fought for democracy,” Mr. Modi said.
